Trademark Registration

If you have already registered your brand name, but in a different class, you're still in luck. Your application is likely to be accepted if the brand is not very well known (McDonald's or Fiat, let's say). If on the other hand, after you have started using it a trademark has been licenced by another brand, you should take the matter seriously. Find out the origin of the merchandise and send a cease-and-desist letter to the office. While it does not refer specifically to intellectual property, in cases of infringement, such a letter is typically sent.
